What can our disciplinary lawyers do for you?

Lawyers at Delissen Martens provide legal assistance to professional service providers in disciplinary cases. This may concern putting forward a defence in disciplinary cases of lawyers, civil-law notaries, accountants or court bailiffs. Sometimes we represent the other party and provide legal assistance to prejudiced clients who file a complaint against a professional.

A complaint will usually precede a liability under civil law. A well-founded complaint may attribute to the substantiation of a failure or of unlawful acts. Delissen Martens is a full-service law firm. Combination and collaboration with lawyers conducting liability matters or financial matters contribute to the expeditious and effective conduct of your case.

Complaints about lawyers

Lawyers can be confronted with complaints made by clients or by the Dean of the Bar Association, which might lead to disciplinary proceedings. Since 2015, the Dean has competence relating to administrative law (imposing a penalty, a fine, directions). Furthermore, lawyers may be confronted with a search of premises conducted by the Public Prosecution Service or with tax audits. It is not advisable for lawyers to conduct their own defence. Moreover, the dynamics within sanctions law against lawyers is usually completely different to what a lawyer is used to in the conduct of his everyday legal cases.

Complaints against civil-law notaries

Civil-law notaries are expected to perform their notarial duties with due care. They are under governmental supervision by the Financial Supervision Office. A complaint about the quality of the services provided by a civil-law notary can be handled by the Disputes Committee for the Notarial Profession. Disciplinary law issues are handled by the Civil-Law Notaries Disciplinary Board. The lawyers at Delissen Martens assist civil-law notaries and clients of civil-law notaries in these proceedings.

Complaints against court bailiffs

The supervision of court bailiffs is carried out by the Financial Supervision Office (Bureau Financieel Toezicht – BFT). The Court Bailiffs Division is in charge of the disciplinary proceedings. We conduct the defence of court bailiffs in disciplinary and civil proceedings.
